 As-Salaam alaykum,
  From whatever way one looks at it, Tawheed (worshipping Allah alone) in Islam is contained in 4 Noble Phrases as follows:--

 SUBHANALLAH, ALHAMDULILLAH,  LAA-ILAHA ILLALLAH,  ALLAHU AKBAR and the hawqalah (La hawla wa la quwata illa billah ). Taken together, these 4 Phrases encompass Tawheed and qadr.

 Ibn Abi Awfaa said a man came to the Prophet, Sallallahu alaihi Wasallam, and said: "I cannot learn the Qur'an, so teach me something that will suffice me. He said, [recite] SUBHANALLAH, WALHAMDULILLAH, WALA ILAHA ILLALLAH, WALLAHU AKBAR, WALA HAWLA WALA QUWATA ILLA BILLAH.."  [Abu Dawud 832, Nisa'ee 2/143].

 Abu Hurairah, may Allah be pleased with him, reported that the Messenger of Allah, Sallallahu alaihi Wasallam, said:- "Shall I inform you of a phrase which is under the throne and from among the treasures of Paradise?  Say, LA-HAWLA WALA QUWATA ILLA BILLAH, Allah will say, 'My servant has submitted himself in intention, action and worship."  [Hakim, Darabi, Fath al-Baari 11/501 ].

 A servant does not control any of his affairs; he does not have the means to repel harm or the ability to attain goodness except by Allah's Will. A servant cannot change disobedience to obedience, sickness to health, weakness to strength, deficiency to perfection except by Allah's Help.

What Allah wills happens and what He does not will won't happen. The affairs of creation are tied to His Decree and Pre-Destination, Tabaraka Wa Ta'ala.

I have been asked a couple of time about this.

I have given a very short response on the matter.

Follow the one you have academic reliance on. If you heart was content with one Mufti, then rely on him and follow him.

Since you cannot see whose arguments are more well grounded, me informing you that I have itminan with Mufti Emran Saheb's view will also only help if you have reliance on my view.

So ask your heart who have you academically relied in this field. Stick to him without thinking anything negative of the other.

My current understanding is as follows (but please not that this is not final conclusion, and do not take it as a fatwa)

In short, I see there are two seperate transactions going on which make the system work.

One is the individual's translation which has to be verified via puzzle which has been randomly generated for the block chain. Merely because the puzzle is randomly generated does not make the transaction void. It could be random, or non-random. It is an external factor. Hence if A sends bitcoin to B, then in itself this transaction is not pending on a chance, rather a jahalat of *when* the randomly generated puzzle will be solved. This jahalat is not mufdi ilal manazi'a. Hence the transaction is sharia compliant.

On the flip side, the generation of bitcoin is dependent on the solving of the same puzzle which was randomly generated.

This will have 2 scenarios.

a. Either the miners have put money to get the bitcoin winnings, (Eg Genesis Mining), then this is gamble as the money they put in is bet for a possible winning in bitcoins.

b. The miner buys his server or uses his computer to mine (i.e solve the puzzle) for winning the bitcoin. In this case he has not placed any maal as bet to get the winning, so this is not gamble and will be shariah compliant.

Hence "b" will be permissible and "a" will not be permissible.

Just for the record, I hold my judgement on the issue of investing in bitcoin. I am constantly making review of the issue, but there are technicalities which Mufti Faraz has not addressed, and I do not wish to formulate the opinion without having full understanding of it.

So my stance is to abstain until issue is more clear.

The article is too long and technical so cannot read all of it...all i've understood is that Mufti Desai sahib is giving evidence that the "new" fatwa given by Mufti Taqi sahib is incorrect.

Any help/comments/advice from Ulama @ ilmhub?

Been bothering Ulama... Alhamdulillah for their patience and time! Allah ta'ala alone can reward them all.
 
Alhamdulillah mind is at rest... both opinions are available though the new fatwa makes it a lot easier on women, Alhamdulillaah, as there is quite a bit of detail to the old one!
